I find that the government’s omission to provide adequate basic maternal health care services in public health facilities violates the right to health. So reads in part the judgement of Justice Barishaki Cheborion of the Constitutional Court. The ruling was delivered on August 19 2020 in relation to the constitutional petition number sixteen. This petition challenged the actions and omissions of the government of Uganda for failure to provide minimum maternal health services including inadequate number of midwives and doctors to provide maternal health services and inadequate budget allocation to the maternal health sector. The government in its unsuccessful defense claimed it was constrained by limited resources. What are the implications of this ruling?
